ZC 2026-11: Stand-alone car lot on SH 78 behind Devonshire Lane homes; staff and P&Z say deny
2021 N. Hwy 78, Wylie · City Council hearing held Tue Oct 13
What's proposed
Replace Special Use Permit 2023-04 with a new SUP. Today the tire and repair shop on Lot 1 may sell cars as a side use from ten parking spaces at the rear. The new SUP would end car sales on Lot 1 and move them to Lot 2, where the applicant (Design3 and Associates, for owner AJ Assets Inc) would build a 3,500 sq ft one-story car-sales building with 68 parking spaces. It would also allow minor auto repair on both lots. The zoning exhibit would serve as the site plan. Brick, stone and stucco exterior; loading at the rear; 24,845 sq ft of landscaping along the parking and the south and east lines; an existing 6-ft masonry wall separates the site from the homes. An amended plat is required before a certificate of occupancy.
Staff recommendation
"Motion to deny the Item as presented." The Planning and Zoning Commission voted 5-0 to recommend denial after discussing how close the site is to homes. Staff notes the site is in the Regional Commercial sector of the land use plan and calls the zoning compatible with it.
Who it helps or hurts
Devonshire Lane homes back up to the site. Owners there wrote in about noise from impact wrenches and air compressors, lighting, cameras, fumes, traffic and home values.
A new auto-sales building on a vacant commercial lot along SH 78; land to the north, east and west is zoned commercial.
Within about 1,000 feet
SH 78 commercial frontage (the Wylie Municipal Complex at 2000 N. State Highway 78 is across the highway); single-family homes on Devonshire Lane and Sheffield Drive to the south.
Watch for
- The new SUP would allow repair on Lot 2 as well as sales, not just move the sales. The architect's drawings are titled "Auto Repair Phase 2."
- No condition limits hours, test drives, outdoor lighting or the number of cars on display.
- Notices went to 33 owners within 200 ft. At posting: five against from inside the notice area, two in favor from outside it.
- With both staff and P&Z recommending denial, Council can still approve. Whether a supermajority is needed is not stated in the packet.
