ZONE-26-0004: Two vacant buildings on Business Park Drive go from Agriculture to light-industrial PD; staff says approve, P&Z said deny
490 Business Park Drive, Prosper · Town Council hearing held Tue Oct 13
What's proposed
Rezone from Agriculture to a Planned Development so the two existing buildings (Building A, 11,297 sq ft; Building B, 7,240 sq ft) can house commercial and light-industrial uses. The PD follows the Commercial District standards except where its own standards differ. The buildings may stay as built, with maintenance and repairs only and no expansions or additions. Permitted uses include office, office/warehouse, office/showroom, limited assembly and manufacturing, contractor's shop (by SUP), minor auto repair (allowed with conditions), major auto repair (conditions plus SUP), indoor gun range (by SUP), indoor veterinarian clinic or kennel, print shop, business service and furniture restoration. The owner dedicates about 30 ft of right-of-way for a future widening of Business Park Drive. The road may first be resurfaced with temporary asphalt; if it is not built to current standards within ten years, the owner must rebuild it at their own expense. 51 parking spaces, a 20-ft landscape buffer on Business Park Drive (15 ft required), and a dry detention pond the owner maintains.
Staff recommendation
"Approval" of the requested Planned Development (staff report: "Town Staff recommends approval"). Staff says the PD upgrades the site while using the existing structures, secures right-of-way for Business Park Drive, and sets standards for the property as it exists. The Planning and Zoning Commission recommended denial on Sept 15, 2026, by 5-1 (Commissioner Butler opposed; Chair Damon Jackson absent). The packet does not give P&Z's reasons.
Who it helps or hurts
The staff report says the site does not abut property zoned or designated for residential use.
Neighbours are light industrial to the north (PD-54) and vacant commercial land east (PD-42), south and west (Commercial Corridor). Reusing the buildings brings activity and a wider Business Park Drive, but uses like major auto repair or an indoor gun range (each needing an SUP) could matter to whoever develops the vacant tracts.
Within about 1,000 feet
light-industrial buildings and vacant Tollway District land along Business Park Drive, south of First Street.
Watch for
- Staff and P&Z disagree: staff recommends approval, and P&Z voted 5-1 to deny. Whether Council needs a supermajority to approve after a P&Z denial is not stated in the packet.
- The use list includes auto repair, an indoor gun range and a contractor's shop. Some need a separate Specific Use Permit later, but minor auto repair would be allowed without one.
- A draft development agreement is attached; the staff report does not summarise its terms.
- Notices went out as required by the Town's code and state law; staff had received no responses at posting.
